Institution for Higher Education Law and Legal Definition
Academies, universities, colleges, seminaries, institutes of technology and certain other collegiate-level institutions, such as vocational schools, trade schools, and career colleges, awarding academic degrees or professional certifications are institutes of higher education.
Institution for higher education is a nonprofit educational institution which is not owned or controlled by the state or any political subdivision, agency, instrumentality, district, or municipality. An institution for higher education provides a program of education beyond the high school level.
An institution for higher education:
(1)admits as regular students only individuals having a certificate of graduation from a high school, or the recognized equivalent of such a certificate;
(2)provides an educational program for which the institute awards a bachelor's degree or provides an educational program, admission into which is conditioned upon the prior attainment of a bachelor's degree or its equivalent, for which it awards a postgraduate degree, or provides not less than a two-year program which is acceptable for full credit toward such a degree; and
(3)is accredited by a nationally recognized accrediting agency or association.[O.C.G.A. § 20-3-201]
